Pgrammer is your platform for practicing coding interview questions and improving your coding skills with the help of AI-generated challenges, hints, and feedback. Pgrammer is a service provided by Shipyard Media ("Shipyard Media," "us," "we," or "our"). These terms and conditions ("Terms," "Agreement") constitute an agreement between Shipyard Media and you ("User," "you," or "your"). This Agreement outlines the general terms and conditions governing your use of the Pgrammer website and its associated products or services (collectively referred to as the "Website" or "Services").
1. Using the Pgrammer Website

Assume all risks associated with the use of the Site, including any content, information, or materials you post or upload to the Site.
2. Content
a. Your Content:
By using the Services provided by Pgrammer, you have the ability to provide Input and receive Output generated by the Services based on that Input. The combination of input and output shall be referred to as "Content." You retain ownership of all Input. Pgrammer grants you all rights, title, and interest in and to the Output generated by the Services, provided you comply with these Terms. This includes the right to use the Content for various purposes, including educational and non-commercial use, in accordance with these Terms. Pgrammer reserves the right to utilize Content for its own purposes, including the provision and improvement of the Services, adherence to applicable laws, and enforcement of its policies. You are solely responsible for ensuring that the Content you provide does not violate any applicable laws or these Terms.
b. Similarity of Content:
It is important to note that due to the nature of machine learning, the Output generated by the Services may not be unique to individual users. It is possible for other users, as well as Pgrammer or third parties, to receive the same or similar Output based on similar inputs. Please be aware that responses generated for other users are not considered part of your Content.
c. Accuracy:
The fields of artificial intelligence and machine learning are constantly evolving. We strive to improve the accuracy, reliability, and usefulness of our Services. However, due to the probabilistic nature of machine learning, the use of our Services may occasionally result in incorrect Output. It is essential that you evaluate the accuracy of any Output for your intended use case. This evaluation may include reviewing and verifying the Output on your own.
d. Use of Content to Improve Services:
We may utilize the Content you provide to develop and enhance our Services.
e. Ownership of User-Generated Code:
As a user of Pgrammer.com, you retain full ownership and intellectual property rights to the code you generate and submit on the platform for answering test questions and quizzes.
f. Usage of User-Generated Code:
By using Pgrammer.com and submitting code for test questions and quizzes, you grant Pgrammer and its affiliates a limited license to use, display, and process your code solely for the purpose of providing the intended service on the platform. This license allows Pgrammer to analyze and evaluate your code to provide you with hints, feedback, and intelligent suggestions to enhance your coding skills and solutions.
g. Confidentiality and Data Security:
We understand the importance of confidentiality and data security. While we may access your code to offer assistance and feedback, we undertake not to disclose your code to third parties without your explicit consent. Your code and answers to quiz questions will be treated with the utmost confidentiality and will not be shared with other users or any unauthorized entities.
h. No Redistribution or Commercial Use:
Pgrammer will not redistribute or commercially exploit your code or answers to quiz questions outside the scope of providing the platform's services. Your code will not be sold, licensed, or shared with any external parties for commercial purposes.
i. Your Responsibilities:
You are solely responsible for ensuring that the code you submit on Pgrammer.com does not violate any applicable laws or the intellectual property rights of third parties. By submitting code, you affirm that you have the right to use and share the code, and that its submission does not infringe upon any proprietary rights.
j. Data Deletion:
You may request the deletion of your user-generated code and related data from Pgrammer's servers at any time by contacting us at mark@shipyard.media. Upon your request, we will promptly remove your code and associated data from our systems, except as required by applicable law or for legitimate business purposes.
k. Acceptance of Ownership of User-Generated Code Section:
By using Pgrammer.com and submitting code for test questions and quizzes, you acknowledge and agree to the terms of this Ownership of User-Generated Code section. If you do not agree to these terms, please refrain from using the Pgrammer platform to submit any code.
l. Use of Content:
When you upload code, challenges, or any other Content to Pgrammer.com, you grant Pgrammer a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and perform such Content in connection with the operation, improvement, and promotion of the Pgrammer platform and services.
3. Disclaimers and Limitations of Liability
a. Disclaimer of Warranties:
We provide the Pgrammer Website, services, information, products, product descriptions, and third-party content on an "As is" and "As available" basis, without any warranties, express or implied. The Shipyard Media entities expressly disclaim all warranties and conditions of merchantability, title, accuracy, and completeness, uninterrupted or error-free service, fitness for a particular purpose, quiet enjoyment, and non-infringement. They also disclaim any warranties arising out of the course of dealing or trade usage.
b. Limitation of Liability:
You agree that to the maximum extent permitted by law, the Shipyard Media entities shall not be held liable under any theory of liability. Specifically, you agree that the Shipyard Media entities will not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, business interruption, reputational harm, or loss of data, arising from or in any way connected with your use of, or inability to use, the Pgrammer Website or products, even if the Shipyard Media entities have been advised of the possibility of such damages or if such damages are foreseeable.
c. No Liability for Third-Party Content and Activities:
The Shipyard Media entities make no guarantees regarding the following, and they expressly disclaim all liability to the maximum extent permitted by law:
Content posted by any third party on the Pgrammer Website.
The quality or conduct of any third party you encounter in connection with your use of the site.
4. Payment
a. Payment Terms:
Certain features or aspects of the Pgrammer Website may require payment, and you agree to pay all fees or charges associated with your Pgrammer account, in accordance with the prevailing fees, charges, and billing terms. In certain cases where we perceive a high risk associated with your transaction, we may request additional verification, such as a copy of your valid government-issued photo identification and possibly a recent bank statement for the credit or debit card used for the purchase. We reserve the right to modify product offerings and pricing at our discretion. Furthermore, we retain the right to decline any orders placed with us. We may also impose limitations on quantities purchased per person, per household, or per order, including orders placed using the same customer account, credit card, or billing and/or shipping address. If we make changes to or cancel an order, we will make reasonable efforts to notify you using the contact information provided during the order placement.
b. Security:

6. Credit Utilization
The term "Credit" refers to the charging of one credit per unique challenge provided by the AI system, irrespective of the number of challenges attempted. We may modify or update the credit utilization system in the future to accommodate the usage of different challenge types.
7. Amendments
We reserve the right to revise and update our fee schedule and Terms at our sole discretion. Notification of any revisions or updates will be made by posting them on our website. The revised fee schedule and Terms will be effective immediately upon posting and apply to all access to and use of the Services thereafter. By continuing to use the Services following any changes, you acknowledge your agreement to be bound by the modified fee schedule and Terms. If you do not agree with the revisions, you should discontinue using the Services. The date of the last update will be indicated in these Terms. As we continue to enhance the Services and introduce new features, we expect you to review this page whenever you access the Services to stay informed about any binding changes.
8. Miscellaneous
You may not transfer or assign any of your rights under these Terms, and any attempt to do so will be null and void. However, Shipyard Media reserves the right to assign its rights to its affiliates, subsidiaries, or any successor in interest associated with the Services. Shipyard Media may review and remove any of Your Content at any time for any reason, including but not limited to violations of the Terms, applicable laws, rules, or regulations, abusive, disruptive, offensive, or illegal activity, or infringement upon the rights of, harm to, or threats against other Service users. You are responsible for any claims, fees, fines, penalties, and other liabilities incurred by us or others due to your breach of the Terms and your use of the Service.
10. Changes to these Terms
We may modify or revise these Terms by posting a revised version on the Pgrammer website or by providing notice to you in other reasonable manners.
